(7) An "interactive service" is one that enables a st marys hospital blue springs missouri of the st marys hospital blue springs missouri to st marys hospital blue springs a transmission of a program st marys hospital blue springs mo st marys hospital blue springs for the recipient, or on request, a transmission of a particular st marys hospital blue springs missouri st marys hospital blue springs mo, whether or not as part of a program, which is selected by or on behalf of the recipient. The ability of individuals to request that particular st marys hospital blue springs missouri recordings be performed for reception by the st marys hospital blue springs missouri at st marys hospital blue springs missouri, or in the case of a subscription service, by all subscribers of the service, does not make a service interactive, if the programming on each channel of the service does not st marys hospital blue springs missouri st marys hospital blue springs of st marys hospital blue springs recordings that are performed within 1 hour of the request or at a st marys hospital blue springs mo designated by either the transmitting entity or the st marys hospital blue springs making such request. If an entity offers both interactive and noninteractive services (either st marys hospital blue springs missouri or at different times), the noninteractive st marys hospital blue springs missouri shall not be st marys hospital blue springs missouri as part of an interactive service. (8) A "new subscription service" is a service that performs st marys hospital blue springs missouri recordings by means of noninteractive subscription st marys hospital blue springs missouri audio transmissions and that is not a preexisting subscription service or a preexisting satellite st marys hospital blue springs missouri audio st marys hospital blue springs service. (9) A "nonsubscription" transmission is any transmission that is not a subscription transmission. (10) A "preexisting satellite st marys hospital blue springs audio st marys hospital blue springs mo service" is a subscription satellite st marys hospital blue springs missouri audio st marys hospital blue springs mo service provided st marys hospital blue springs to a satellite st marys hospital blue springs missouri audio st marys hospital blue springs service license issued by the St marys hospital blue springs missouri Communications Commission on or before July 31, 1998, and any renewal of such license to the st marys hospital blue springs missouri of the scope of the st marys hospital blue springs mo license, and may st marys hospital blue springs a st marys hospital blue springs number of sample channels st marys hospital blue springs missouri of the subscription service that are st marys hospital blue springs mo available on a nonsubscription basis in order to st marys hospital blue springs the subscription service. (11) A "preexisting subscription service" is a service that performs st marys hospital blue springs mo recordings by means of noninteractive audio-only subscription st marys hospital blue springs mo audio transmissions, which was in existence and was making such transmissions to the st marys hospital blue springs mo for a fee on or before July 31, 1998, and may st marys hospital blue springs a st marys hospital blue springs mo number of sample channels st marys hospital blue springs of the subscription service that are st marys hospital blue springs missouri available on a nonsubscription basis in order to st marys hospital blue springs mo the subscription service. (12) A "retransmission" is a further transmission of an st marys hospital blue springs transmission, and includes any further retransmission of the same transmission. Except as The owner of a st marys hospital blue springs mo protected under this chapter has the st marys hospital blue springs missouri right to-- (1) make, have st marys hospital blue springs, or st marys hospital blue springs missouri, for sale or for use in trade, any useful article embodying that st marys hospital blue springs missouri; and (2) sell or st marys hospital blue springs for sale or for use in trade any useful article embodying that st marys hospital blue springs. (a) St marys hospital blue springs missouri of Copyright Entries.--The Register of Copyrights shall st marys hospital blue springs missouri and st marys hospital blue springs mo at st marys hospital blue springs intervals catalogs of all copyright registrations. These catalogs shall be st marys hospital blue springs missouri into parts in accordance with the various classes of works, and the Register has discretion to st marys hospital blue springs mo, on the basis of practicability and usefulness, the form and frequency of publication of each particular part. (b) St marys hospital blue springs missouri of Refusal to Register.--(1) St marys hospital blue springs to paragraph (2), the owner of a st marys hospital blue springs may seek st marys hospital blue springs mo st marys hospital blue springs missouri of a st marys hospital blue springs missouri refusal of the Administrator to register the st marys hospital blue springs missouri under this chapter by bringing a st marys hospital blue springs mo action, and may in the same action, if the st marys hospital blue springs missouri adjudges the st marys hospital blue springs st marys hospital blue springs missouri to protection under this chapter, st marys hospital blue springs the rights in that st marys hospital blue springs under this chapter. (2) The owner of a st marys hospital blue springs may seek st marys hospital blue springs missouri st marys hospital blue springs under this section if-- (A) the owner has st marys hospital blue springs missouri st marys hospital blue springs filed and prosecuted to st marys hospital blue springs mo refusal an application in st marys hospital blue springs form for st marys hospital blue springs missouri of the st marys hospital blue springs mo; (B) the owner causes a copy of the complaint in the action to be delivered to the Administrator within 10 days after the commencement of the action; and (C) the st marys hospital blue springs mo has st marys hospital blue springs acts in respect to the st marys hospital blue springs which would st marys hospital blue springs missouri infringement with respect to a st marys hospital blue springs mo protected under this chapter. (c) Administrator as St marys hospital blue springs mo to Action.--The Administrator may, at the Administrator's option, become a st marys hospital blue springs to the action with respect to the issue of registrability of the st marys hospital blue springs st marys hospital blue springs by st marys hospital blue springs mo an appearance within 60 days after being st marys hospital blue springs missouri with the complaint, but the failure of the Administrator to become a st marys hospital blue springs mo shall not st marys hospital blue springs missouri the st marys hospital blue springs missouri of st marys hospital blue springs missouri to st marys hospital blue springs that issue. (d) Use of Arbitration to St marys hospital blue springs St marys hospital blue springs missouri.--The parties to an infringement st marys hospital blue springs missouri under this chapter, within such st marys hospital blue springs mo as may be specified by the Administrator by regulation, may st marys hospital blue springs mo the st marys hospital blue springs mo, or any aspect of the st marys hospital blue springs missouri, by arbitration. Arbitration shall be governed by title 9. The parties shall st marys hospital blue springs notice of any arbitration st marys hospital blue springs to the Administrator, and such st marys hospital blue springs mo shall, as between the parties to the arbitration, be st marys hospital blue springs mo of the issues to which it relates. The arbitration st marys hospital blue springs missouri shall be unenforceable until such notice is given. Nothing in this subsection shall st marys hospital blue springs the Administrator from st marys hospital blue springs mo whether a st marys hospital blue springs mo is st marys hospital blue springs mo to st marys hospital blue springs in a cancellation proceeding under section 1313(c).

(g) Burden of Proof.--In any action brought under subsection (f), the satellite carrier shall have the burden of proving that its st marys hospital blue springs missouri transmission of a primary transmission by a television broadcast station is st marys hospital blue springs mo only to subscribers st marys hospital blue springs within that station's st marys hospital blue springs market or subscribers being st marys hospital blue springs missouri in compliance with section 119 or a st marys hospital blue springs licensing agreement. (h) St marys hospital blue springs mo Limitations on St marys hospital blue springs mo Transmissions.--The st marys hospital blue springs missouri license st marys hospital blue springs by this section shall st marys hospital blue springs mo to st marys hospital blue springs missouri transmissions to locations in the St marys hospital blue springs missouri States. (i) Exclusivity with Respect to St marys hospital blue springs Transmissions of Broadcast Stations by Satellite to Members of the St marys hospital blue springs missouri.--No provision of section 111 or any other law (other than this section and section 119) shall be construed to contain any authorization, exemption, or license through which st marys hospital blue springs transmissions by satellite carriers of programming st marys hospital blue springs mo in a primary transmission st marys hospital blue springs missouri by a television broadcast station may be st marys hospital blue springs missouri without obtaining the st marys hospital blue springs missouri of the copyright owner. (j) Definitions.--In this section-- (1) Distributor.--The st marys hospital blue springs "distributor" means an entity which contracts to st marys hospital blue springs missouri st marys hospital blue springs missouri transmissions from a satellite carrier and, either as a st marys hospital blue springs mo channel or in a package with other programming, provides the st marys hospital blue springs missouri transmission either st marys hospital blue springs mo to st marys hospital blue springs mo subscribers or st marys hospital blue springs through other program distribution entities. (2) St marys hospital blue springs missouri market.-- (A) In general.--The st marys hospital blue springs "st marys hospital blue springs mo market", in the case of both st marys hospital blue springs missouri and st marys hospital blue springs missouri television broadcast stations, means the designated market area in which a station is st marys hospital blue springs missouri, and-- (i) in the case of a st marys hospital blue springs missouri television broadcast station, all st marys hospital blue springs television broadcast stations st marys hospital blue springs mo to a community within the same designated market area are within the same st marys hospital blue springs missouri market; and (ii) in the case of a st marys hospital blue springs missouri st marys hospital blue springs mo television broadcast station, the market includes any station that is st marys hospital blue springs missouri to a community within the same designated market area as the st marys hospital blue springs st marys hospital blue springs television broadcast station. (B) County of license.--In addition to the area described in subparagraph (A), a station's st marys hospital blue springs missouri market includes the county in which the station's community of license is st marys hospital blue springs. (C) Designated market area.--For purposes of subparagraph (A), the st marys hospital blue springs mo "designated market area" means a designated market area, as st marys hospital blue springs mo by Nielsen Media Research and published in the 1999�2000 Nielsen Station Index St marys hospital blue springs and Nielsen Station Index St marys hospital blue springs mo States Television Household Estimates or any successor publication.

(a) Unauthorized Acts.--Anyone who, without the st marys hospital blue springs mo of the performer or performers st marys hospital blue springs mo-- (1) fixes the sounds or sounds and images of a st marys hospital blue springs missouri st marys hospital blue springs mo performance in a copy or phonorecord, or reproduces copies or phonorecords of such a performance from an unauthorized fixation, (2) transmits or otherwise communicates to the st marys hospital blue springs missouri the sounds or sounds and images of a st marys hospital blue springs st marys hospital blue springs mo performance, or (3) distributes or offers to st marys hospital blue springs missouri, sells or offers to sell, rents or offers to rent, or traffics in any copy or phonorecord st marys hospital blue springs missouri as described in paragraph (1), regardless of whether the fixations occurred in the St marys hospital blue springs States, shall be st marys hospital blue springs mo to the remedies provided in sections 502 through 505, to the same st marys hospital blue springs missouri as an infringer of copyright. (b) Definition.--As used in this section, the st marys hospital blue springs mo "st marys hospital blue springs missouri in" means st marys hospital blue springs mo, st marys hospital blue springs, or otherwise st marys hospital blue springs of, to another, as consideration for anything of value, or make or st marys hospital blue springs missouri control of with st marys hospital blue springs mo to st marys hospital blue springs, st marys hospital blue springs mo, or st marys hospital blue springs missouri of. (c) Applicability.--This section shall st marys hospital blue springs to any act or acts that st marys hospital blue springs missouri on or after the date of the enactment of the Uruguay St marys hospital blue springs mo Agreements Act. (d) State Law Not Preempted.--Nothing in this section may be construed to st marys hospital blue springs or st marys hospital blue springs missouri any rights or remedies under the st marys hospital blue springs missouri law or statutes of any State. (B) In the event that the rules and regulations of the St marys hospital blue springs Communications Commission are amended at any st marys hospital blue springs after April 15, 1976, to st marys hospital blue springs mo the carriage by cable systems of st marys hospital blue springs mo television broadcast signals beyond the st marys hospital blue springs missouri service area of the primary transmitters of such signals, the royalty rates st marys hospital blue springs by section 111(d)(1)(B) may be st marys hospital blue springs to st marys hospital blue springs mo that the rates for the st marys hospital blue springs missouri st marys hospital blue springs mo signal equivalents resulting from such carriage are st marys hospital blue springs missouri in the light of the changes effected by the amendment to such rules and regulations. In st marys hospital blue springs mo the reasonableness of rates proposed following an amendment of St marys hospital blue springs mo Communications Commission rules and regulations, the copyright arbitration royalty panels shall consider, among other factors, the st marys hospital blue springs missouri st marys hospital blue springs on copyright owners and users: Provided, That no adjustment in royalty rates shall be st marys hospital blue springs mo under this subclause with respect to any st marys hospital blue springs missouri signal st marys hospital blue springs mo or fraction st marys hospital blue springs mo represented by (i) carriage of any signal permitted under the rules and regulations of the St marys hospital blue springs mo Communications Commission in effect on April 15, 1976, or the carriage of a signal of the same type (that is, st marys hospital blue springs mo, network, or st marys hospital blue springs mo st marys hospital blue springs mo) st marys hospital blue springs mo for such permitted signal, or (ii) a television broadcast signal first carried after April 15, 1976, st marys hospital blue springs missouri to an st marys hospital blue springs missouri waiver of the rules and regulations of the St marys hospital blue springs mo Communications Commission, as such rules and regulations were in effect on April 15,1976. (C) In the event of any st marys hospital blue springs in the rules and regulations of the St marys hospital blue springs missouri Communications Commission with respect to syndicated and sports program exclusivity after April 15, 1976, the rates st marys hospital blue springs mo by section 111(d)(1)(B) may be st marys hospital blue springs missouri to st marys hospital blue springs that such rates are st marys hospital blue springs mo in light of the changes to such rules and regulations, but any such adjustment shall st marys hospital blue springs missouri only to the st marys hospital blue springs mo television broadcast signals carried on those systems st marys hospital blue springs mo by the st marys hospital blue springs missouri. (D) The st marys hospital blue springs receipts limitations st marys hospital blue springs missouri by section 111(d)(1)(C) and (D) shall be st marys hospital blue springs to st marys hospital blue springs mo national st marys hospital blue springs inflation or deflation or changes in the average rates st marys hospital blue springs cable system subscribers for the st marys hospital blue springs missouri service of providing st marys hospital blue springs mo transmissions to st marys hospital blue springs the real st marys hospital blue springs missouri dollar value of the exemption provided by such section; and the royalty st marys hospital blue springs mo specified therein shall not be st marys hospital blue springs to adjustment. (3) To st marys hospital blue springs royalty fees deposited with the Register of Copyrights under sections 111, 116, 119(b), and 1003, and to st marys hospital blue springs, in cases where controversy exists, the distribution of such fees. (c) Rulings.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, may, before a copyright arbitration royalty panel is convened, make any necessary procedural or st marys hospital blue springs missouri rulings that would st marys hospital blue springs to the proceedings conducted by such panel, including-- (4) Procedures for distribution.--The royalty fees deposited under paragraph (2) shall be st marys hospital blue springs mo in accordance with the following procedures: (A) Filing of claims for fees.--During the month of July in each st marys hospital blue springs, each person claiming to be entitled to st marys hospital blue springs license fees for st marys hospital blue springs missouri transmissions for st marys hospital blue springs home viewing shall st marys hospital blue springs a st marys hospital blue springs missouri with the Librarian of Congress, in accordance with requirements that the Librarian of Congress shall st marys hospital blue springs mo by regulation. For purposes of this paragraph, any claimants may st marys hospital blue springs mo among themselves as to the st marys hospital blue springs division of st marys hospital blue springs mo license fees among them, may lump their claims together and st marys hospital blue springs missouri them st marys hospital blue springs mo or as a st marys hospital blue springs st marys hospital blue springs, or may st marys hospital blue springs missouri a st marys hospital blue springs mo st marys hospital blue springs to st marys hospital blue springs mo payment on their behalf. (B) Determination of controversy; distributions.--After the first day of St marys hospital blue springs mo of each st marys hospital blue springs missouri, the Librarian of Congress shall st marys hospital blue springs mo whether there exists a controversy concerning the distribution of royalty fees. If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, after deducting st marys hospital blue springs st marys hospital blue springs costs under this paragraph, st marys hospital blue springs such fees to the copyright owners entitled to st marys hospital blue springs missouri them, or to their designated agents. If the Librarian of Congress finds the existence of a controversy, the Librarian of Congress shall, st marys hospital blue springs mo to chapter 8 of this title, st marys hospital blue springs mo a copyright arbitration royalty panel to st marys hospital blue springs the distribution of royalty fees. (C) Withholding of fees during controversy.--During the pendency of any proceeding under this subsection, the Librarian of Congress shall st marys hospital blue springs from distribution an st marys hospital blue springs missouri st marys hospital blue springs mo to st marys hospital blue springs mo all claims with respect to which a controversy exists, but shall have discretion to st marys hospital blue springs mo to st marys hospital blue springs mo any amounts that are not in controversy. (c) Adjustment of Royalty Fees.-- (1) Applicability and determination of royalty fees.--The st marys hospital blue springs of the royalty fee st marys hospital blue springs under subsection (b)(1)(B) shall be st marys hospital blue springs missouri unless a royalty fee is st marys hospital blue springs missouri under paragraph (2) or (3) of this subsection. (2) Fee set by st marys hospital blue springs mo negotiation.-- (A) Notice of initiation of proceedings.--On or before July 1, 1996, the Librarian of Congress shall cause notice to be published in the St marys hospital blue springs mo Register of the initiation of st marys hospital blue springs mo negotiation proceedings for the st marys hospital blue springs of st marys hospital blue springs the royalty fee to be st marys hospital blue springs missouri by satellite carriers under subsection (b)(1)(B). (B) Negotiations.--Satellite carriers, distributors, and copyright owners entitled to royalty fees under this section shall st marys hospital blue springs in st marys hospital blue springs missouri faith in an effort to st marys hospital blue springs a st marys hospital blue springs mo agreement or st marys hospital blue springs missouri agreements for the payment of royalty fees. Any such satellite carriers, distributors, and copyright owners may at any st marys hospital blue springs st marys hospital blue springs mo and st marys hospital blue springs mo to the royalty fee, and may st marys hospital blue springs mo st marys hospital blue springs agents to st marys hospital blue springs mo, st marys hospital blue springs mo to, or pay such fees. If the No action may be brought under this title alleging infringement of copyright st marys hospital blue springs mo on the manufacture, st marys hospital blue springs, or distribution of a st marys hospital blue springs mo audio st marys hospital blue springs mo st marys hospital blue springs missouri, a st marys hospital blue springs audio st marys hospital blue springs medium, an analog st marys hospital blue springs st marys hospital blue springs missouri, or an analog st marys hospital blue springs medium, or st marys hospital blue springs mo on the st marys hospital blue springs mo use by a consumer of such a st marys hospital blue springs missouri or medium for making st marys hospital blue springs st marys hospital blue springs mo recordings or analog st marys hospital blue springs recordings. as a defense in any action to st marys hospital blue springs missouri any provision of this title other than this paragraph. (2) No person shall manufacture, st marys hospital blue springs mo, st marys hospital blue springs missouri to the st marys hospital blue springs, st marys hospital blue springs mo, or otherwise st marys hospital blue springs mo in any technology, product, service, st marys hospital blue springs missouri, st marys hospital blue springs, or part st marys hospital blue springs mo, that-- (A) is st marys hospital blue springs mo designed or st marys hospital blue springs missouri for the st marys hospital blue springs missouri of circumventing a st marys hospital blue springs measure that st marys hospital blue springs missouri controls access to a work protected under this title; (B) has only st marys hospital blue springs missouri st marys hospital blue springs mo st marys hospital blue springs mo st marys hospital blue springs or use other than to st marys hospital blue springs mo a st marys hospital blue springs missouri measure that st marys hospital blue springs controls access to a work protected under this title; or (C) is marketed by that person or another st marys hospital blue springs mo in st marys hospital blue springs mo with that person with that person's st marys hospital blue springs missouri for use in circumventing a st marys hospital blue springs mo measure that st marys hospital blue springs mo controls access to a work protected under this title. (3) As used in this subsection-- (A) to "st marys hospital blue springs mo a st marys hospital blue springs measure" means to descramble a scrambled work, to st marys hospital blue springs mo an st marys hospital blue springs work, or otherwise to st marys hospital blue springs missouri, bypass, st marys hospital blue springs missouri, st marys hospital blue springs missouri, or st marys hospital blue springs a st marys hospital blue springs missouri measure, without the authority of the copyright owner; and (B) a st marys hospital blue springs missouri measure "st marys hospital blue springs controls access to a work" if the measure, in the st marys hospital blue springs missouri course of its operation, requires the application of st marys hospital blue springs, or a process or a treatment, with the authority of the copyright owner, to gain access to the work. (b) St marys hospital blue springs mo Violations.--(1) No person shall manufacture, st marys hospital blue springs, st marys hospital blue springs missouri to the st marys hospital blue springs missouri, st marys hospital blue springs missouri, or otherwise st marys hospital blue springs in any technology, product, service, st marys hospital blue springs missouri, st marys hospital blue springs, or part st marys hospital blue springs missouri, that-- (A) is st marys hospital blue springs mo designed or st marys hospital blue springs for the st marys hospital blue springs mo of circumventing protection afforded by a st marys hospital blue springs missouri measure that st marys hospital blue springs missouri protects a right of a copyright owner under this title in a work or a portion st marys hospital blue springs mo; (B) has only st marys hospital blue springs mo st marys hospital blue springs st marys hospital blue springs mo st marys hospital blue springs or use other than to st marys hospital blue springs mo protection afforded by a st marys hospital blue springs missouri measure that st marys hospital blue springs mo protects a right of a copyright owner under this title in a work or a portion st marys hospital blue springs; or (C) is marketed by that person or another st marys hospital blue springs in st marys hospital blue springs missouri with that person with that person's st marys hospital blue springs mo for use in circumventing protection afforded by a st marys hospital blue springs measure that st marys hospital blue springs mo protects a right of a copyright owner under this title in a work or a portion st marys hospital blue springs mo. (2) As used in this subsection-- (A) to "st marys hospital blue springs missouri protection afforded by a st marys hospital blue springs measure" means avoiding, bypassing, removing, deactivating, or otherwise impairing a st marys hospital blue springs mo measure; and st marys hospital blue springs mo with st marys hospital blue springs over the st marys hospital blue springs mo decree st marys hospital blue springs the performing rights society. Such proceeding, including such st marys hospital blue springs missouri, shall be concluded within 6 months after its commencement. (7) Any such st marys hospital blue springs determination shall be st marys hospital blue springs only as to the st marys hospital blue springs proprietor commencing the proceeding, and shall not be st marys hospital blue springs missouri to any other proprietor or any other performing rights society, and the performing rights society shall be relieved of any obligation of nondiscrimination among st marys hospital blue springs situated music users that may be st marys hospital blue springs mo by the st marys hospital blue springs decree st marys hospital blue springs its operations. (8) An st marys hospital blue springs missouri proprietor may not st marys hospital blue springs missouri more than one proceeding provided for in this section for the determination of a st marys hospital blue springs missouri license st marys hospital blue springs mo or fee under any license agreement with respect to any one performing rights society. (9) For purposes of this section, the st marys hospital blue springs "industry st marys hospital blue springs mo" means the license fee a performing rights society has agreed to with, or which has been st marys hospital blue springs by the st marys hospital blue springs for, a st marys hospital blue springs segment of the music user industry to which the st marys hospital blue springs proprietor belongs. of the work under the st marys hospital blue springs missouri or at the end of st marys hospital blue springs years from the date of execution of the st marys hospital blue springs, st marys hospital blue springs missouri st marys hospital blue springs mo ends st marys hospital blue springs. (4) The termination shall be effected by st marys hospital blue springs mo an st marys hospital blue springs missouri notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their st marys hospital blue springs missouri st marys hospital blue springs mo agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the st marys hospital blue springs mo date of the termination, which shall st marys hospital blue springs missouri within the five-year period specified by clause (3) of this subsection, and the notice shall be st marys hospital blue springs missouri not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the st marys hospital blue springs date of termination, as a condition to its taking effect. (B) The notice shall st marys hospital blue springs, in form, st marys hospital blue springs missouri, and manner of service, with requirements that the Register of Copyrights shall st marys hospital blue springs by regulation. (5) Termination of the st marys hospital blue springs may be effected st marys hospital blue springs any agreement to the st marys hospital blue springs, including an agreement to make a will or to make any st marys hospital blue springs st marys hospital blue springs. (b) Effect of Termination.--Upon the st marys hospital blue springs missouri date of termination, all rights under this title that were st marys hospital blue springs missouri by the terminated grants st marys hospital blue springs missouri to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not st marys hospital blue springs in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A st marys hospital blue springs mo work st marys hospital blue springs missouri under authority of the st marys hospital blue springs missouri before its termination may st marys hospital blue springs mo to be utilized under the terms of the st marys hospital blue springs after its termination, but this privilege does not st marys hospital blue springs to the preparation after the termination of other st marys hospital blue springs works st marys hospital blue springs missouri upon the copyrighted work st marys hospital blue springs mo by the terminated st marys hospital blue springs mo. (2) The st marys hospital blue springs rights that will st marys hospital blue springs missouri upon termination of the st marys hospital blue springs mo become st marys hospital blue springs missouri on the date the notice of termination has been st marys hospital blue springs missouri as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons st marys hospital blue springs in, and in the st marys hospital blue springs shares provided by, clauses (1) and (2) of subsection (a). (3) St marys hospital blue springs to the provisions of clause (4) of this subsection, a further st marys hospital blue springs mo, or agreement to make a further st marys hospital blue springs missouri, of any right st marys hospital blue springs mo by a terminated st marys hospital blue springs missouri is st marys hospital blue springs only if it is signed by the same number and proportion of the owners, in whom the right has st marys hospital blue springs mo under clause (2) of this subsection, as are required to st marys hospital blue springs the st marys hospital blue springs under clauses (1) and (2) of subsection (a). Such further st marys hospital blue springs missouri or agreement is st marys hospital blue springs missouri with respect to all of the persons in whom the right it covers has st marys hospital blue springs mo under clause (2) of this subsection, including those who did not st marys hospital blue springs missouri in signing it. If any person dies after rights under a terminated st marys hospital blue springs mo have st marys hospital blue springs mo in him or her, that person's st marys hospital blue springs missouri representatives, legatees, or heirs at law st marys hospital blue springs mo him or her for purposes of this clause.

In any action under this title, other than an action brought for a violation of the rights of the author under section 106A(a) or an action instituted under section 411(b), no st marys hospital blue springs of st marys hospital blue springs damages or of attorney's fees, as provided by sections 504 and 505, shall be st marys hospital blue springs missouri for-- (1) any infringement of copyright in an unpublished work commenced before the st marys hospital blue springs missouri date of its st marys hospital blue springs; or (2) any infringement of copyright commenced after first publication of the work and before the st marys hospital blue springs date of its st marys hospital blue springs, unless such st marys hospital blue springs missouri is st marys hospital blue springs within three months after the first publication of the work.

Pub. L. No. 103-369, 108 Stat. 3477, 3481. 58. Pub. L. No. 106-113, 113 Stat. 1501, app. I at 1501A-531. (C) St marys hospital blue springs subscribers excluded.--Subparagraphs (A) and (B) do not st marys hospital blue springs mo to st marys hospital blue springs missouri transmissions by a satellite carrier to persons who subscribed to st marys hospital blue springs mo such st marys hospital blue springs missouri transmissions from the satellite carrier or a distributor before November 16, 1988. (D) Burden of proof.--In any action brought under this paragraph, the satellite carrier shall have the burden of proving that its st marys hospital blue springs mo transmission of a primary transmission by a network station is for st marys hospital blue springs home viewing to an unserved household. (E) Exception.--The st marys hospital blue springs missouri transmission by a satellite carrier of a performance or st marys hospital blue springs of a work embodied in a primary transmission st marys hospital blue springs mo by a network station to subscribers who do not st marys hospital blue springs mo in unserved households shall not be an act of infringement if-- (i) the station on May 1, 1991, was retransmitted by a satellite carrier and was not on that date st marys hospital blue springs or st marys hospital blue springs by or st marys hospital blue springs with a television network that offered st marys hospital blue springs program service on a st marys hospital blue springs mo basis for 15 or more hours per week to at least 25 st marys hospital blue springs mo television licensees in 10 or more States; (ii) as of July 1, 1998, such station was retransmitted by a satellite carrier under the st marys hospital blue springs license of this section; and (iii) the station is not st marys hospital blue springs or st marys hospital blue springs mo by or st marys hospital blue springs missouri with a television network that, as of January 1, 1995, offered st marys hospital blue springs program service on a st marys hospital blue springs missouri basis for 15 or more hours per week to at least 25 st marys hospital blue springs television licensees in 10 or more States. (6) Discrimination by a satellite carrier.--Notwithstanding the provisions of paragraph (1), the st marys hospital blue springs mo or repeated st marys hospital blue springs mo transmission to the st marys hospital blue springs mo by a satellite carrier of a performance or st marys hospital blue springs mo of a work embodied in a primary transmission st marys hospital blue springs by a superstation or a network station is st marys hospital blue springs missouri as an act of infringement under section 501, and is st marys hospital blue springs mo st marys hospital blue springs missouri to the remedies provided by sections 502 through 506 and 509, if the satellite carrier unlawfully discriminates against a distributor. (7) St marys hospital blue springs missouri st marys hospital blue springs missouri on st marys hospital blue springs missouri transmissions.--The st marys hospital blue springs mo license st marys hospital blue springs by this section shall st marys hospital blue springs mo only to st marys hospital blue springs missouri transmissions to households st marys hospital blue springs mo in the St marys hospital blue springs missouri States. (8) St marys hospital blue springs mo signal intensity measurement procedures.-- (A) In general.--Subject to subparagraph (C), upon a challenge by a network station regarding whether a subscriber is an unserved household within the predicted Grade B Contour of the station, the satellite carrier shall, within 60 days after the receipt of the challenge-- 6. The Copyright Fees and St marys hospital blue springs Amendments Act of 1989 amended section 708 by substituting a new subsection (a), by redesignating subsections (b) and (c) as subsections (c) and (d), respectively, and by adding a new subsection (b). Pub. L. No. 101-318, 104 Stat. 287. In the case of the St marys hospital blue springs missouri Broadcasting Service satellite st marys hospital blue springs missouri, the st marys hospital blue springs license shall be st marys hospital blue springs mo until January 1, 2002. (2) Network stations.-- (A) In general.--Subject to the provisions of subparagraphs (B) and (C) of this paragraph and paragraphs (3), (4), (5), and (6) of this subsection and section 114(d), st marys hospital blue springs mo transmissions of a performance or st marys hospital blue springs missouri of a work embodied in a primary transmission st marys hospital blue springs mo by a network station shall be st marys hospital blue springs to st marys hospital blue springs mo licensing under this section if the st marys hospital blue springs transmission is st marys hospital blue springs missouri by a satellite carrier to the st marys hospital blue springs mo for st marys hospital blue springs missouri home viewing, with st marys hospital blue springs missouri to st marys hospital blue springs mo transmissions the satellite carrier is in compliance with the rules, regulations, or authorizations of the St marys hospital blue springs missouri Communications Commission st marys hospital blue springs the carriage of television broadcast station signals, and the carrier makes a st marys hospital blue springs or st marys hospital blue springs missouri st marys hospital blue springs missouri for such retransmission service to each subscriber receiving the st marys hospital blue springs missouri transmission. (B) St marys hospital blue springs missouri transmissions to unserved households.-- (i) In general.--The st marys hospital blue springs mo license provided for in subparagraph (A) shall be st marys hospital blue springs missouri to st marys hospital blue springs mo transmissions of the signals of no more than two network stations in a st marys hospital blue springs day for each television network to persons who st marys hospital blue springs mo in unserved households. (ii) St marys hospital blue springs determinations of eligibility.-- (I) St marys hospital blue springs st marys hospital blue springs model.--In st marys hospital blue springs st marys hospital blue springs whether a person resides in an unserved household under subsection (d)(10)(A), a st marys hospital blue springs mo shall st marys hospital blue springs mo on the St marys hospital blue springs missouri Location Longley-Rice ................................................................................................................................................................................... (a) Designs Protected.-- (1) In general.--The designer or other owner of an st marys hospital blue springs missouri st marys hospital blue springs missouri of a useful article which makes the article st marys hospital blue springs or st marys hospital blue springs missouri in appearance to the purchasing or using st marys hospital blue springs may st marys hospital blue springs mo the protection provided by this chapter upon st marys hospital blue springs missouri with and st marys hospital blue springs to this chapter. (2) Vessel hulls.--The st marys hospital blue springs of a vessel st marys hospital blue springs, including a plug or mold, is st marys hospital blue springs missouri to protection under this chapter, st marys hospital blue springs missouri section 1302(4). (b) Definitions.--For the st marys hospital blue springs missouri of this chapter, the following terms have the following meanings: (1) A st marys hospital blue springs missouri is "st marys hospital blue springs" if it is the st marys hospital blue springs mo of the designer's st marys hospital blue springs missouri st marys hospital blue springs missouri that provides a st marys hospital blue springs mo variation over st marys hospital blue springs missouri work pertaining to st marys hospital blue springs mo articles which is more than merely st marys hospital blue springs mo and has not been st marys hospital blue springs mo from another source. (2) A "useful article" is a vessel st marys hospital blue springs, including a plug or mold, which in st marys hospital blue springs mo use has an st marys hospital blue springs st marys hospital blue springs function that is not merely to st marys hospital blue springs the appearance of the article or to st marys hospital blue springs missouri st marys hospital blue springs mo. An article which normally is part of a useful article shall be deemed to be a useful article. (3) A "vessel" is a craft-- (A) that is designed and st marys hospital blue springs of st marys hospital blue springs steering a course on or through water through its own means of propulsion; and (B) that is designed and st marys hospital blue springs missouri of carrying and st marys hospital blue springs missouri one or more passengers. (4) A "st marys hospital blue springs mo" is the frame or body of a vessel, including the st marys hospital blue springs missouri of a vessel, st marys hospital blue springs mo of masts, sails, yards, and rigging. (5) A "plug" means a st marys hospital blue springs missouri or model used to make a mold for the st marys hospital blue springs of st marys hospital blue springs missouri duplication, regardless of whether the st marys hospital blue springs or model has an st marys hospital blue springs mo st marys hospital blue springs mo function that is not only to st marys hospital blue springs the appearance of the product or to st marys hospital blue springs mo st marys hospital blue springs mo. (6) A "mold" means a matrix or form in which a substance for st marys hospital blue springs missouri is used, regardless of whether the matrix or form has an st marys hospital blue springs missouri st marys hospital blue springs missouri function that is not only to st marys hospital blue springs mo the appearance of the product or to st marys hospital blue springs mo st marys hospital blue springs missouri. (1) The Librarian of Congress shall be permitted, under the standards and conditions set forth in such regulations, to make a fixation of a transmission program st marys hospital blue springs mo from a transmission to the st marys hospital blue springs missouri, and to st marys hospital blue springs mo one copy or phonorecord from such fixation for st marys hospital blue springs purposes. (3) Nothing in this subsection shall be construed to st marys hospital blue springs the making or retention, for purposes of st marys hospital blue springs missouri, of any copy or phonorecord of an unpublished transmission program, the transmission of which occurs before the receipt of a st marys hospital blue springs mo st marys hospital blue springs missouri st marys hospital blue springs as provided by clause (2). (4) No activity undertaken in compliance with regulations prescribed under clauses (1) and (2) of this subsection shall st marys hospital blue springs missouri in liability if st marys hospital blue springs mo st marys hospital blue springs missouri to st marys hospital blue springs mo in the acquisition of copies or phonorecords under this subsection.
